Unnao Rape Case: Plea in Supreme Court Challenges Suspension of Kuldeep Sengar’s Jail Term

New Delhi (FNO): A plea has been filed in the Supreme Court challenging the Allahabad High Court’s order suspending the jail sentence of former Uttar Pradesh MLA Kuldeep Singh Sengar, who was convicted in the Unnao rape case.

 

The petition, filed by advocates Anjale Patel and Pooja Shilpkar, seeks an immediate stay on the High Court’s order, arguing that the suspension of sentence was granted without due consideration of the trial court’s findings.

The petitioners contended that the trial court had categorically observed that Sengar must remain in prison for the remainder of his natural life, given the gravity of the crime and his criminal antecedents. They argued that the High Court failed to adequately weigh this observation while granting suspension of sentence.

 

According to the plea, the High Court committed a grave error of law and facts by granting relief to Sengar despite his established involvement in the heinous offence of rape and his history of serious criminal conduct.

The advocates further submitted that allowing suspension of sentence in such a case undermines the seriousness of the crime and could set a dangerous precedent, particularly in offences involving sexual violence.

The Supreme Court is expected to hear the matter shortly. The outcome of the plea is being closely watched, given the significance of the Unnao rape case and its broader implications for justice delivery in cases of crimes against women
